Public Records And Employment
In today's society, most employers run a background check at some point during the hiring process to research a candidate's background and to determine their trustworthiness as an employee. They are looking for information on your file to judge your character, to identify any potential hiring risks, to confirm information found on an employment application or resume, and for safety and security reasons. Employers have an obligation to create a safe work environment for their existing employees and to prevent employment issues in the workplace. For that reason background checks are absolutely necessary in positions that require security or trust; ie; positions that are responsible for children and the elderly, in addition to schools, hospitals, financial institutions, airports, ports of entry, driving, and people who hold government offices.
All public record information will show up on a background check including: criminal records, arrest records, outstanding warrants, court records, employment history, property records, previous addresses, age, known aliases, marriage/divorce records, military records, and more. Employers that run a background check on potential employees are bound by U. S. law to abide by The Fair Credit Reporting Act (FCRA). The FCRA is legislation that requires an employer to get your consent before running a background check on you. Background Checks And Firearms
The Brady Handgun Violence Prevention Act, put into effect on February 28, 1994, is an Act that requires background checks on firearm purchases in the United States. The Act came after an assassination attempt on President Ronald Reagan in 1981. The President's assistant, James Brady, for whom the act was named was shot and seriously injured in the incident.
The Brady Act requires that background checks be conducted before an individual can purchase a firearm from a federally licensed dealer, manufacturer or importer. It prohibits certain persons from shipping or transporting any firearm in interstate or foreign commerce, or receiving any firearm which has been shipped or transported in interstate or foreign commerce, or possessing any firearm in or affecting commerce.
These restrictions apply to any person who has been convicted of a crime and imprisoned for more than one year, a fugitive of justice, an individual who had been adjudicated as a mental defective or committed to a mental institution, is an alien or illegally in the United States, had a dishonorable discharge from the Armed Forces, is subject to a restraining order for harassing, stalking, or threatening a person or child, or has been convicted of a misdemeanor or domestic violence.
